Terms of Service

1. Introduction

These Terms of Service (the “Terms”) govern your access to and use of MiaUmbria (the “Platform”), a map-first event discovery service for Umbria available at miaumbria.com and related domains/subdomains.

The Platform allows users to:

  • Browse local events in Umbria on an interactive map
  • Filter events by category and date
  • View event details and link to external event pages
  • Submit event links via a guest form (no account required)

Editors and publishers use the same backend for content management and moderation.

These Terms apply to all users, including visitors, event submitters, editors, and publishers (collectively “you” or “Users”). Where mandatory consumer protection rules under Estonian or EU law provide greater protection, those rules prevail.

By accessing or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.

3. Purpose and Scope of the Platform

MiaUmbria is an informational platform that aggregates and displays public event information for Umbria on an interactive map. It helps users discover events but does not organize, host, sell tickets for, or guarantee any events.

  • All event data comes from external sources or user submissions.
  • We moderate content using our internal workflows, but we do not independently verify every detail (accuracy, safety, legality, or occurrence of events).
  • Links lead to third-party websites; we are not responsible for their content or transactions.

The Platform does not facilitate binding contracts between users and event organizers unless separately agreed.

Listing an event does not imply endorsement, sponsorship, or verification by Cetmix OÜ.

4. User Accounts and Guest Submissions

  • Most features (browsing, filtering, viewing details) are available without an account.
  • You may submit event links as a guest. Submitted content is subject to review and moderation.
  • Editors/publishers may have elevated access through the backend, governed by the same Terms plus any separate agreements.

You are responsible for the accuracy and legality of any content you submit.

By submitting content, you represent and warrant that:

  • you have the right to share the content and any linked material
  • the content does not infringe any third-party rights
  • the information is accurate to the best of your knowledge

You must be at least 16 years old to use the Platform.

5. Intellectual Property Rights

All Platform content (design, code, logos, maps interface, text, graphics, etc.) is owned by or licensed to Cetmix OÜ and protected by intellectual property laws.

You may use the Platform for personal, non-commercial discovery of events. You are not permitted to:

  • Scrape, crawl, or systematically extract data (except as permitted by law for public search engines)
  • Use automated systems, bots, scripts, or scraping tools to access, extract, or index the Platform without authorization
  • Reproduce, modify, distribute, or commercially exploit Platform content or features without prior written permission
  • Use the map or event data in competing services

Event content submitted by users or sourced externally remains the responsibility of the original provider. By submitting events, you grant Cetmix OÜ a worldwide, non-exclusive, royalty-free license to display, moderate, and distribute that content on the Platform.

6. Trademarks

MiaUmbria, Mapilus, and related logos are trademarks of Cetmix OÜ. No license to use them is granted by these Terms.

7. Acceptable Use

You agree not to:

  • Submit false, misleading, infringing, defamatory, or illegal event information
  • Use the Platform for unlawful purposes or to promote harmful activities
  • Attempt to bypass moderation, security, or technical measures
  • Introduce viruses, spam, or overload the system
  • Impersonate others or misrepresent affiliations

We may use automated systems to detect spam, abuse, or suspicious activity.

We may modify, format, categorize, or edit submitted content to improve presentation and consistency on the Platform.

We reserve the right to remove content, reject submissions, suspend or terminate access, or ban users at any time, without prior notice, if you violate these Terms or if required for security, operational, or legal reasons.

8. No Warranties

The Platform and all content are provided “as is” and “as available”.

We do not warrant that:

  • Events are accurate, safe, or will take place
  • The map or filters will function without interruption or error
  • All submitted content has been fully verified

We do not guarantee that the Platform will be available at all times or free from interruptions. Maintenance, updates, or technical issues may result in temporary unavailability.

To the maximum extent permitted by law, all implied warranties are excluded.

9. Limitation of Liability

To the maximum extent permitted by law, Cetmix OÜ shall not be liable for:

  • Any damages arising from reliance on event information
  • Cancellation, changes, or issues with third-party events
  • Indirect, consequential, or punitive damages
  • Data loss or technical issues

These limitations do not apply to liability that cannot be excluded under mandatory Estonian or EU law (e.g., death/personal injury due to negligence, fraud).

10. External Links and Third-Party Content

The Platform contains links to external event pages. We are not responsible for third-party websites, their privacy practices, or any transactions you make there.

External links may change, become unavailable, or be modified by third parties over time.

11. Privacy and Cookies

Your use of the Platform is governed by our Privacy Policy and Cookie Policy, which describe how we process personal data.

12. Modifications

We may update these Terms at any time. Changes become effective upon publication. Continued use after updates constitutes acceptance. We will notify material changes where reasonably practicable (e.g., via banner or email if you have an account).

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Estonia.

Disputes shall be subject to the jurisdiction of Estonian courts, subject to any mandatory consumer protection rules granting you additional rights in your country of residence within the European Union.

Nothing in this section limits your rights as a consumer to bring claims before the courts of your country of residence within the European Union.

15. Reporting Content and Illegal Material

If you believe that any content on the Platform is illegal or infringes your rights, you may report it by contacting us at privacy@cetmix.com or via available reporting tools on the Platform.

We will review such reports and may remove or restrict access to the content where appropriate.

We may also take action against users who repeatedly submit unlawful, infringing, or abusive content.
